Overview and Acceptance

JustPropertySearch (“we,” “us,” or “our”) provides a software-as-a-service platform for advanced property search tools, data exports, intelligent lead classification, list management, and analytics across residential, commercial, and vacant land properties. These Terms of Service (“Terms”) govern your use of the JustPropertySearch website and services (“Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

User Eligibility: The Service is intended for users located in the United States. By using the Service, you represent and warrant that you are using it from within the U.S. and that you have the legal capacity to enter into this agreement. We impose no strict age restrictions; however, if you are a minor (under the age of majority in your state), you should use the Service with the consent of a parent or guardian. The Service is not intended for children under 13, and we do not knowingly allow such individuals to use the Service or collect their personal information (see Privacy Policy for details).

Account Creation and Security

Account Registration: To access many features of JustPropertySearch, you must create an account. Account registration is handled through our third-party authentication provider, Clerk, which securely manages your login and credentials. You agree to provide accurate and current information during registration and to update it as needed. All account information (such as your name and email) is collected and processed in accordance with our Privacy Policy and Clerk's practices.

Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Immediately notify us if you suspect any unauthorized use of your account or any security breach. We use Clerk to help protect your account, but you must also safeguard your password and authentication details. JustPropertySearch will not be liable for any loss or damage arising from your failure to keep your account secure. You should use a strong, unique password and enable any available security features to protect your account.

Subscription Plans and Payments

Subscription Services: JustPropertySearch operates on a subscription model. Certain advanced features (such as extensive data exports or premium analytics) may require a paid subscription. By signing up for a paid plan, you agree to pay the subscription fees indicated for that plan. Fees may be billed monthly or annually in advance, as described at the time of purchase.

Payment Processing: All payments are processed securely by our third-party payment processor, Stripe. We do not collect or store your full credit card information on our servers, as Stripe handles all payment transactions. For more information on how Stripe handles your data, please refer to Stripe's Privacy Policy. You must provide a valid payment method (e.g. credit card) and hereby authorize JustPropertySearch to charge your payment method through Stripe for all applicable fees.

Billing and Renewal: Subscription charges will be billed on a recurring basis according to your billing cycle (e.g. on the same date each month for monthly plans). If a payment fails (for example, due to an expired card or insufficient funds), we may attempt to retry billing; if payment remains unsuccessful, we reserve the right to suspend or terminate your access to paid features. JustPropertySearch is not responsible for any issues or errors caused by Stripe's payment processing, and any payment disputes should be addressed with Stripe or your payment provider. Prices are subject to change, but any changes will be communicated to you and will take effect at the start of your next billing cycle.

Refunds: All subscription fees are non-refundable. Users can cancel at any time during the free trial period. After a paid subscription begins, users can cancel their subscription at any time, but the cancellation will only take effect at the end of the current billing period. We do not provide pro-rated refunds for partial billing periods. If you believe you have been charged in error, please contact us promptly so we can review the issue.

Permitted Use and User Conduct

Use of the Service: We grant you a limited, non-exclusive, non-transferable license to access and use JustPropertySearch and the content made available through it for your personal or internal business purposes, in accordance with these Terms. You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.

Prohibited Activities: You must not misuse the Service. In particular, you agree not to:

• Violate any applicable laws or regulations while using JustPropertySearch, including real estate marketing laws and data privacy laws.
• Attempt to gain unauthorized access to the Service or our systems (for example, by hacking, password "mining," or any other illegitimate means).
• Interfere with or disrupt the integrity or performance of the Service, including by introducing viruses or other harmful code.
• Reverse engineer, decompile, or disassemble any aspect of the Service, or attempt to derive the source code or underlying ideas or algorithms of any part of the platform.
• Use any automated system (such as bots, spiders, or scrapers) to access the Service or extract data, except via our provided features (e.g. authorized data exports or APIs) and in compliance with our usage guidelines.
• Resell, rent, or sublicense the Service or data obtained from the Service to third parties without our prior written permission. The property data, leads, and analytics you obtain are for your use only in connection with JustPropertySearch, and not for redistribution or creating a competing database or service.
• Upload, transmit, or distribute any malicious or unlawful material via the Service. Since JustPropertySearch does not host user-generated content publicly, this primarily applies to any data you might import into your account (such as contact lists or notes). If you do input any of your own data, you must have the rights to that data and it must not violate any laws or third-party rights.

Violation of any of the above may result in immediate termination or suspension of your access to the Service, at our discretion, and may subject you to legal consequences.

Intellectual Property Rights

Ownership: All content, data, software, text, graphics, logos, and interactive features provided through the JustPropertySearch Service (collectively, "Content") are the property of JustPropertySearch or its licensors and are protected by United States and international intellectual property laws. This includes, without limitation, our databases of property listings and information, the design and functionality of our search tools, our algorithms for lead classification, and all trademarks, service marks, and logos contained in the Service. JustPropertySearch retains all rights, title, and interest in and to its Content.

Limited License to Users: Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service and its Content for its intended purposes. This means you may view and utilize property data and analytics for your personal use or internal business operations (for example, to inform your real estate decisions or marketing efforts). You may not copy, modify, distribute, or create derivative works based on our Content without our prior written consent. For instance, you cannot scrape our property database to create your own service, or republish our analytics in bulk. Any unauthorized use of the Content or Service will terminate the license granted by us and may result in legal action.

Feedback: If you provide us with any feedback or suggestions regarding the Service, we may use and incorporate such feedback without any obligation to you. Any such feedback is entirely voluntary, and we have no confidentiality obligations with respect to it.

Disclaimer of Warranties

"As-Is" Service: JustPropertySearch is provided on an "as is" and "as available" basis. We make no warranties or representations of any kind, express or implied, about the accuracy, reliability, completeness, or timeliness of the Service or any content accessed through it. This includes, without limitation, the property data, analytics, and any results or recommendations from our lead classification or search tools. Your use of the Service is at your own risk.

No Guaranteed Outcomes: You acknowledge that real estate markets and data can be unpredictable. JustPropertySearch's tools (such as lead scoring or property analytics) are for informational purposes only and are not guaranteed to result in any particular outcome (for example, successful sales or acquisitions). We do not provide legal, financial, or real estate advice. You should independently verify any critical information before relying on it in a real estate transaction.

Specific Disclaimers: To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We cannot guarantee the continuous or fault-free operation of the platform, or that any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, our warranties will be limited to the minimum extent permitted by law.

Limitation of Liability

Indirect Damages: To the maximum extent permitted by law, JustPropertySearch and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages whatsoever arising from or relating to your use of (or inability to use) the Service. This includes, but is not limited to, damages for lost profits or revenues, business interruption, loss of business opportunities, goodwill, data loss, or other intangible losses, even if we have been advised of the possibility of such damages.

Aggregate Liability Cap: In no event will our total liability to you for all claims relating to the Service exceed the amount you have paid to us (if any) in the last twelve (12) months for the Service. If you have not paid any fees to us (for example, if you are using a free version of the Service), JustPropertySearch's total liability shall not exceed $100. This limitation applies to any claim based on warranty, contract, tort (including negligence), strict liability, or any other legal theory.

Scope of Limitations: The limitations of liability set forth in this section shall apply to the fullest extent permitted by law, and regardless of the form of action, whether in contract, tort, strict liability, or otherwise. These limitations will apply even if any limited remedy fails of its essential purpose. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so certain limitations above may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

Termination

Termination by JustPropertySearch: We reserve the right to terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, your violation of these Terms, a request by law enforcement or other government agencies, discontinuance or material modification of the Service, unexpected technical or security issues, or non-payment of fees. If your account is terminated or suspended, whether by you or by us, your right to access the Service will immediately cease. We may also delete or disable access to all information and data associated with your account. You agree that we have no liability to you or any third party for termination of your account or access to the Service.

Termination by You: You may cancel your account or subscription at any time if you wish to stop using our Service. If you terminate a paid subscription, you may lose access to features provided under that subscription at the end of your billing period (we do not typically provide refunds for mid-period cancellations, as noted above).

Survival: Upon termination of these Terms, any provision that by its nature or express terms should survive will survive, including but not limited to ownership provisions, warranty disclaimers, limitations of liability, and indemnification (if applicable), and any obligations to pay fees accrued prior to termination.

Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict of law principles. By using the Service, you agree that any dispute arising from or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state or federal courts located in Georgia. You consent to the personal jurisdiction of such courts for litigating any such disputes. If you reside outside of Georgia, or the dispute involves parties in different jurisdictions, you agree that Georgia law will still apply and Georgia courts will have jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Changes to These Terms

JustPropertySearch may modify or update these Terms from time to time. If we make material changes, we will provide notice to you by email (if you have provided one) or by prominently posting a notice on our website. Continued use of the Service after updated Terms become effective constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes. The "Last Updated" date at the end of this document indicates when the latest modifications were made.

No Waiver and Severability

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.

Entire Agreement

These Terms (along with the JustPropertySearch Privacy Policy) constitute the entire agreement between you and JustPropertySearch regarding your use of the Service, and supersede any prior agreements or understandings, whether written or oral, relating to the same subject matter. No oral or written information or advice given by us or our authorized representatives shall create any warranties or contractual obligations beyond those expressly stated in these Terms.
